Consultation on the new Vic Mental Health and Wellbeing Act

The Royal Commission into Victoria’s Mental Health System recommended the Government replace the current Mental Health Act 2014 with a new Mental Health and Wellbeing Act to support the aspiration of rebuilding the mental health system.

The new legislation will establish the foundation for the new mental health and wellbeing system in Victoria. As outlined in the Mental Health and Wellbeing Act: Update and Engagement Paper, the Department of Health is consulting on the following areas of the new Act:

  • Objectives and principles
  • Non-legal advocacy supports
  • Supported decision-making
  • Information sharing
  • Compulsory treatment
  • Seclusion and restraint
  • Governance and oversight

NDS will be making a submission and invites members to give feedback to help inform this submission. Please send any comments to  submit enquiry/feedback by Friday, 23 July.

Submissions from the public close 11.59pm on 1 August 2021.
