Second Fair Work Bill to ‘close the loopholes’ passes in parliament

On 12 February, the Fair Work Legislation Amendment (Closing the Loopholes No. 2) Bill 2023 passed through the Senate and amendments were accepted by the Lower House. It is now passed as legislation, with changes being introduced between now and next year. It follows the first part of this legislation (Closing the Loopholes No. 1) that came in on 14 December last year.
Many of the changes will affect providers, especially those employing casual staff. Some worker rights, such as the right to disconnect and the right to receive communications from unions, have been strengthened. Gig workers have been given more protection and intentional wage theft has become a criminal offence.
