Who is this resource for?

All levels of government across Australia, as well as private businesses looking to procure products and services from Disability Enterprises for specific contracts and projects. To assist in this process, NDS offers a contract management service – BuyAbility Procurement.

Background:

In mid-2009, the NSW Government enacted legislation which enabled its agencies to procure goods and services directly from disability employment organisations.

These organisations are collectively known as 'Australian Disability Enterprises.' The 2009 legislation was explained in the Premier's Memorandum 2010-6, relating to policy background and expected outcomes.

The original legislation has been transferred to the Public Works and Procurement Regulation 2014. This exists as Clause 5 within the Regulation.

Clause 5 eliminates the need for NSW Government agencies to conduct open, competitive tenders, when engaging Australian Disability Enterprises.

In addition, NSW Government agencies can engage Australian Disability Enterprises who supply goods and services listed in State Contracts without reference to State Contracts.

BuyAbility Procurement is the government-endorsed service enabling this regulation. NDS launched its BuyAbility initiative in 2016 to promote and secure a thriving supported employment sector – one that produces high-quality products and services and meaningful employment and training opportunities for people with disability.

This program was previously referred to as the Disability Enterprise Procurement Program.
