Member consultation on new draft Victorian Portable Long Service Scheme Regulations and Regulatory Impact Statement
22/05/2020
The Draft Regulations are different from the previous Interim Regulations, aiming to address issues with the coverage and operational aspects of the portable long service benefits scheme. The most significant proposed changes included in the draft Regulations are:
- Abolishing the 'employee predominance test' for the community services sector, replacing it with a test based on award coverage. (An individual is prescribed not to be an employee for the community services sector unless the individual is employed under one of the following awards: the Social, Community, Home Care and Disability Services Industry Award 2010; the Children's Services Award 2010; the Educational Services (Teachers) Award 2010; the Labour Market Assistance Industry Award 2020.)
- Treating community health centres and women’s health services in the same way as other service providers. This will mean that they will be covered if they provide a service that is a community service, and if they employ persons under the relevant awards. Employers for those services will only have to pay the levy for their eligible workers performing community service work.
The Draft Regulations and the RIS are available via the Engage Victoria website, where a summary of the proposed changes to the Regulations, and indicative questions to consider when making submissions can also be found.
NDS is seeking feedback on the changes listed above, as well as the impact of the current regulations on your organisations.
We are particularly interested in examples of the specific impact and costs of the Long Service Benefits Scheme on your organisation, and any issues which may arise for your organisation if the scope of the Scheme is related to award coverage.
