The High Court today overturned the decision of the Full Court of the Federal Court concerning the way paid personal/carer's leave is calculated under the National Employment Standards (NES).

The High Court ruling in effect means that:

Members should examine whether the High Court’s ruling on how personal/carer’s leave is calculated is consistent with their payroll practice, or whether an adjustment should now be made.
