The Full Bench of the Federal Court has dismissed an Application by AED Legal to disallow the Fair Work Commission’s (FWC) proposed wages setting methodology and classification structure (the Framework) for the SES Award. The decision by the Court to notify the parties that the Application had been dismissed almost immediately after submissions had ended, is a welcome one.

The Court heard various legal arguments as to whether or not the Framework breached Commonwealth legislation, including the Fair Work Act and Disability Discrimination Act.
