News flash: Directors of Integrity Care charged over death

Following an investigation into the death of Adelaide woman Ann Marie Smith, who died in April 2020, ABC News has reported that disability service provider Integrity Care has been charged with offences relating to the death. Two directors have also been charged with criminal neglect causing death and failing to comply with a health and safety duty of care. 

The criminal charges announced today are in addition to the legal action launched in March this year by the NDIS Commission.  

The death of Ann Marie Smith is a pivotal case that brings to light the important responsibilities that directors of disability services have in providing quality services and supports for people with disability, and their failure to meet these will not only be to the detriment of their clients but can result in criminal charges. 

Directors of companies are legally obliged to ensure their health and safety obligations are carried out. The community rightly expects organisations who accept the responsibility to care for vulnerable people will deliver that care to the highest standard.  

NDS will continue to assist organisations to operate under the NDIS and fulfil their commitment to providing high quality service and support. Resources including Zero Tolerance guidance are freely available to all disability service providers. 

People with disability must be able to live their lives free from fear of violence, abuse, neglect and exploitation, while accessing quality disability services and support.
