Consultation underway on amendments to the NDIS Act

Exposure drafts of changes to the NDIS Act and several NDIS Rules are available for comment until 7 October 2021, with a view to having them tabled in Parliament later this year. Many of the proposed changes relate to findings from the 2019 Tune Review of the NDIS Act.

Proposed amendments to the NDIS Act would see the Participant Service Guarantee (already being reported on quarterly) legislated. This inclusion would be supported by the creation of a new Rule. Another change would be to the eligibility criteria to reinforce “that impairments resulting from psychosocial disability (or mental health condition) that are episodic, fluctuating or varying in intensity may still be regarded as permanent, and references to ‘psychiatric conditions’ will be replaced with ‘psychosocial disability’.”
